1. Program Overview
The Someone You Can Count On, LLC ("SYCCO," "we," "us," or "our") Affiliate Program allows approved participants ("Affiliates," "you," or "your") to earn commissions by referring new paying subscribers to the SYCCO platform at someoneyoucancounton.com (the "Service"). By participating in the Affiliate Program, you agree to these terms.
2. Eligibility & Enrollment
- You must have an active SYCCO account (free or paid) to participate.
- Affiliate status is granted at SYCCO's sole discretion. We review each application manually to maintain program quality.
- You must be at least 18 years of age or the age of legal majority in your jurisdiction.
- SYCCO reserves the right to deny, suspend, or terminate affiliate status at any time, with or without cause.
- No paid subscription is required to participate or earn commissions.
3. Commission Structure
Commissions are earned when a referred user signs up using your unique referral link and completes their first paid subscription payment. The commission amounts are:
| Subscription Tier | Monthly Price | Your Commission |
|---|---|---|
| Starter | $29/mo | $5 |
| Plus | $99/mo | $10 |
| Pro | $300/mo | $75 |
| Business | $450/mo | $125 |
- Commissions are one-time payments per referred subscriber, earned on their first successful payment.
- Commission amounts are subject to change. Any changes will be communicated in advance and will not affect commissions already earned.
- Self-referrals (referring yourself or accounts you control) are strictly prohibited and will result in immediate termination and forfeiture of all unpaid commissions.
4. Referral Tracking
- Referrals are tracked via a unique referral link and/or code assigned to your account.
- Referral cookies last 30 days from the date the potential customer clicks your link. If the customer signs up and pays within that window, the referral is credited to you.
- If a referred customer clears their cookies or uses a different device, the referral may not be tracked. SYCCO is not responsible for lost referrals due to technical limitations.
- In cases of multiple affiliates claiming the same referral, the first click will be credited.
5. Payout Schedule & 60-Day Hold Period
⚠️ All commissions are subject to a mandatory 60-day hold period from the date the referred customer's payment clears.
- 60-Day Hold: Commissions become eligible for payout 60 days after the referred customer's first successful payment. This hold period protects against chargebacks, disputes, and fraudulent transactions.
- Payout Processing: After the 60-day hold has cleared, eligible commissions are processed at the end of each calendar month. For example, a commission that clears its 60-day hold on March 15 will be included in the March payout batch.
- Minimum Payout: There is no minimum payout threshold. Any cleared commission will be paid out.
- Payment Methods: Payouts can be processed via Stripe, PayPal, or direct deposit — your choice. Payment method must be configured before payout processing.
- Tax Responsibility: Affiliates are responsible for all applicable taxes on commission income. SYCCO may require a W-9 (U.S.) or W-8BEN (international) form for payouts exceeding $600 in a calendar year.
6. Chargebacks, Disputes & Commission Clawback
⚠️ Affiliates are financially liable for commissions associated with chargebacks, disputes, or fraudulent transactions.
- Chargeback Clawback: If a referred customer initiates a chargeback, dispute, or payment reversal with their bank or credit card issuer — for any reason — the associated commission will be immediately revoked.
- Unpaid Commissions: If the commission has not yet been paid out, it will simply be removed from your pending balance.
- Already-Paid Commissions: If the commission has already been paid to you, SYCCO reserves the right to deduct the amount from future commission payouts. If no future payouts are available, SYCCO may invoice you for the amount owed.
- Fraud Pattern Detection: If SYCCO detects a pattern of chargebacks or disputes associated with your referrals (e.g., 2 or more chargebacks within a 90-day period), your affiliate account may be suspended pending investigation, and all pending commissions may be frozen.
- No Fault Clause: This policy applies regardless of whether the chargeback is the affiliate's fault. The affiliate assumes all risk associated with the quality and intent of the customers they refer.
7. Prohibited Activities
The following activities are strictly prohibited and will result in immediate termination and forfeiture of all unpaid commissions:
- Spam: Sending unsolicited bulk emails, messages, or communications to promote your referral link.
- Misleading Claims: Making false, deceptive, or misleading claims about SYCCO, its features, pricing, or earning potential.
- Brand Impersonation: Impersonating SYCCO, its employees, or official communications.
- Incentivized Signups: Offering monetary incentives, cashback, or gifts to induce signups through your referral link (unless explicitly approved by SYCCO in writing).
- Self-Referrals: Creating multiple accounts or referring yourself or accounts you own or control.
- Paid Ads on Branded Terms: Running paid advertising campaigns that bid on "SYCCO," "Someone You Can Count On," or other SYCCO branded keywords without prior written approval.
- Cookie Stuffing: Using hidden iframes, forced redirects, or any technique to artificially set referral cookies.
- Trademark Misuse: Using SYCCO trademarks or logos in a manner that suggests endorsement or partnership beyond the affiliate relationship.
8. Intellectual Property
- SYCCO grants affiliates a limited, non-exclusive, revocable license to use SYCCO marketing materials (provided through the Launch Kit and Sales Playbook) for the sole purpose of promoting referral links.
- You may not modify SYCCO logos, trademarks, or brand assets without prior written approval.
- All SYCCO intellectual property remains the property of Someone You Can Count On, LLC.
9. Termination
- Either party may terminate the affiliate relationship at any time, with or without cause.
- Upon termination by you, any commissions that have cleared the 60-day hold period will still be paid out in the next payout cycle.
- Upon termination by SYCCO for cause (violation of these terms), all pending and unpaid commissions are forfeited.
- Upon termination, you must immediately cease all use of SYCCO marketing materials and remove all referral links.
10. Limitation of Liability
- SYCCO's total liability to any affiliate is limited to the total commissions actually paid to that affiliate in the 12 months preceding the claim.
- SYCCO is not liable for lost referrals due to technical issues, cookie limitations, browser settings, or user behavior.
- SYCCO is not responsible for any loss of income, profits, or business resulting from changes to the program, commission rates, or these terms.
11. Modifications
SYCCO reserves the right to modify these terms, commission rates, payout schedules, or any aspect of the Affiliate Program at any time. Material changes will be communicated via email to active affiliates. Continued participation in the program after changes constitutes acceptance of the updated terms. Changes to commission rates will not apply retroactively to commissions already earned.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of the State of Arizona.
